Statement in Response to CPS Lawsuit

“It is now very clear that CPS, unlike many other cities and municipalities, did not properly prepare in advance of the storm to be able to provide electricity to its captive customers throughout the duration of the storm. Now, they are diverting the spotlight from their reckless and incompetent actions in order to avoid paying their bills. CPS is trying to play politics and place blame on others. Due to their miscalculations of the severity of the storm and their lack of competent planning, they needed to purchase natural gas and electricity at the prevailing market prices during the storm in order to meet critical human needs for the citizens of San Antonio. The gas that we sold to CPS was at fully negotiated and transparent pricing. They were not obligated to purchase any gas from us. Yet after agreeing to a fully negotiated price they then received and consumed the gas knowing full well the purchase price in advance. Energy Transfer also allowed CPS to take gas above and beyond volumes CPS agreed to purchase in order to help their customers. It now seems evident that CPS agreed to prices and then received and consumed the natural gas with no intention of honoring the agreement. The facts will clearly show that the citizens of San Antonio deserve better,” said Tom Long and Mackie McCrea, Co-CEOs of Energy Transfer.
